1. Scope and provider

These terms of use apply to the Oudena app and its services (account, synchronisation, training links, AI Ride Builder). The provider is Kristof Van Ende, Lachmannstr. 10, 38102 Braunschweig, Germany, email: kontakt@oudena.app.

For App Store downloads, Apple's standard end-user licence agreement also applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ – in case of conflict these terms prevail, to the extent Apple permits.

2. Services

Oudena connects to compatible smart trainers and lets you ride real routes, catalog routes, workouts and AI-generated routes as indoor training. The app is currently offered free of charge. Should paid features be added later, they will be offered exclusively through Apple and clearly marked in the app beforehand.

We continuously develop the app. Features may change or be discontinued; we announce significant restrictions in the app.

3. Account

An account is required to use the app. Keep your sign-in details confidential. You can delete your account in the app at any time, which ends your use.

4. Health and safety

Indoor training is physically demanding. Check with a doctor whether you are fit to train before you start, especially if you have pre-existing conditions. Stop training immediately if you feel pain, dizziness or unwell.

Oudena controls the resistance of your smart trainer. Make sure your setup is safe and stable and that no people or animals are near moving parts. Figures for power, speed, calories or FTP are estimates, not medical information.

5. Routes and AI-generated content

Routes, elevation profiles and AI-generated routes are for indoor training only. They say nothing about whether a route can be ridden outdoors, is permitted or is safe. Do not use them for navigation on public roads. AI results may contain errors.

6. Your content and shared trainings

Only import files you have the necessary rights to. You grant us the simple rights to store and process your content to the extent needed to operate the app.

When you share a training or upload it to Strava, a public link is created that anyone with the link can view for 30 days. Do not share anything you do not want to publish. You can revoke links in the app.

7. Third-party services

The terms of the respective providers also apply to Strava, Apple Health, Sign in with Apple and Google sign-in. We are not responsible for their availability.

8. Availability

We strive for uninterrupted operation but cannot guarantee constant availability, in particular during maintenance, outages of external services or without an internet connection.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In cases of slight negligence we are liable only for breach of an essential contractual obligation whose fulfilment makes proper use possible in the first place and on whose observance you may rely, and limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded.

10. Changes to these terms

We may change these terms when the app or the law changes. We will inform you of significant changes in the app in advance. If you continue to use the app afterwards, the amended terms apply; you can delete your account at any time.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country in which you habitually reside remain unaffected. Should a provision be invalid, the remaining provisions remain valid.
